| 探索《国家公园法》立法进程困境和制约因素，推
进《国家公园法》的出台，是中国特色自然保护地体系建立的
迫切现实需求。运用专家德尔菲法，选取不同利益相关者专家
代表，通过质性分析和层次分析法，探析立法困境的维度及各
维度的权重。研究得出，目前的立法困境主要包括立法过程、
立法主体、立法支撑条件3个维度，以及立法理念、立法目标
等14个三级指标；主要的立法制约因素包括立法支撑条件不
充分、立法过程中尚有难题待解决，以及立法主体深陷改革现
实困境等；最后，提出推进中国《国家公园法》立法进程的相
关建议，如深入国家公园试点开展实践、拓宽利益相关者参与
渠道、明确立法目标及理念等。 |

| Research on the Legislative Dilemma and Restrictive Factors of National Park Law in China Based on Delphi Method |

| Abstract: |
| The paper explores the difficulties and constraints
in the process of national park legislation. Advancing the
promulgation of the "National Park Law" is an urgent and realistic
need for establishing the system of nature reserves with Chinese
characteristics. Using the Delphi method, this research selects the
experts representing different stakeholders, through qualitative
analysis and analytic hierarchy process, to explore the dimensions
of legislative dilemma and the weight of each dimension. The
main conclusions of the research include three dimensions of the
legislative dilemma (the legislative process, the legislative subject,
and the legislative support conditions) and 14 three-level indicators
such as legislative ideas and legislative goals. The main influencing
factors include legislative constraints, insufficient legislative
support conditions, difficult problems in the legislative process,
and the legislative bodies' dilemma. Finally, this research makes
some suggestions like deepening the pilot practice, broadening the
channels for stakeholder participation, and clarifying the legislative
goals and concepts based on the research findings. |
